Menlo College student arrested for raping a 12-year-old

A Menlo College student has been arrested for raping a 12-year-old, a prosecutor said today (May 18). 

Andres Manuel Aguilar, 19, of San Jose, is being charged with a felony of sexual assault toward a 12-year-old girl, District Attorney Steve Wagstaffe said. 

Aguilar met with the girl on May 5 at around 9 p.m., after she snuck out of her home, Wagstaffe said. They had previously met at a bus stop near the college on El Camino Real, and Aguilar thought she was 17, according to Wagstaffe.  

That night, they walked to Safeway and bought beer and rum and walked back to Aguilar’s dorm in the college. They both drank and smoked marijuana until Aguilar took off her pants, the DA said. The girl repeatedly told Aguilar no, but he sexually assaulted her before raping the girl, despite her repeatedly telling him no, Wagstaffe said. 

Aguilar was worried she would get pregnant and ordered Plan B on DoorDash, according to Wagstaffe. 

The next day, the girl went to school and reported the incident to a school administrator, who then called Child Protective Services and her mom. The girl was then taken to Stanford Hospital for treatment. 

Aguilar is in jail on no bail status. He will be in court on May 21.
