More inmates charged in deadly jail beating of Mountain View man

Three more inmates have been charged in a fatal beating of a Mountain View man at a Santa Clara County jail, court records show.

The attack was allegedly motivated by Norteno gang leaders, Detective David Carroll said in his police report.

Cameras at the Elmwood Jail in Milpitas picked up a meeting where the words “Sureno” and “he can’t be here,” were said at 11:38 a.m. on Jan. 27, Carroll said.

Oscar Umul Xicay, 23, of Mountain View, walked out of the showers at 11:45 a.m., and two inmates walked up to him and blocked him from walking down the aisle to his bunk bed, police said.

A third inmate joined them, and they pulled Umul Xicay back into the showers away from the cameras, police said. Loud banging and shouting were heard on the audio, police said.

At 11:49 a.m., Umul Xicay appeared twice in the camera’s view until an inmate dragged him back to the showers, police said.

At 11:51 a.m., Umul Xicay walked back to a bunk bed, sat down and wiped blood from his mouth, police said. Inmates kept punching him in the head, police said. Umul Xicay then stood with his back against a window. An inmate lifted himself up between two bunk beds and used both feet to kick Umul Xicay’s chest, sending Umul Xicay’s head back against the window and causing the window to shatter, police said.

He didn’t fight back

At 11:55 p.m., Umul Xicay was motionless on the floor as one inmate stomped his head and another inmate kicked his waist, police said.

“At no point in the surveillance footage did victim Oscar fight back in any manner against any of the three suspects,” Carroll wrote in his report.

At 12:03 p.m., a deputy found Umul Xicay unresponsive on the floor and called for medics, police said. A portion of Umul Xicay’s skull was removed at the hospital because of brain swelling, police said.

Was in jail for vandalism

Umul Xicay was arrested 12 hours earlier for vandalism outside the police headquarters in Mountain View. He pulled out a stake holding up a tree and shook a gate keypad until he knocked it over, Officer Maxamilian Miller said in his police report.

Umul Xicay died at the hospital on Feb. 4.

The original suspects were Jose Rufino, 18, of San Jose; Jordan Haase, 38, of San Jose; and Pedro Arevalos, 41, of San Mateo. They’re charged with murder and torture.

Fight captured on video

Carroll reviewed the security footage and said three more inmates — Ricardo Charles, 20, Alexavier Victor Rodriguez, 20, and Alex Arrelo, 34 — were involved in planning the attack and keeping other inmates away. Arrelo allegedly stopped two inmates from defending Umul Xicay and mopped blood from the showers afterwards, police said.

Rodriguez allegedly blocked Umul Xicay’s exit path, police said.

Charles allegedly tried to join the fight but was called off by Arevalos, police said.

Charles “continued watching the fight and was laughing throughout it,” police said.
